It is strictly prohibited to copy the artist’s work, without the artist’s consent, in whole or in part, including any form of imitation, technique or pictorial writing that is exclusive to the artist and protected by copyright law.
In conformity with international copyright laws, all infringements may be subject to judicial proceedings.
Summary of key provisions of the Canadian Copyright Act (Copyright Act
(RSC (1986) ch. C-42) which is similar in scope to American copyright legislation and international conventions to which both nations are signatories:
The reproduction or communication to the public of all or a significant part of a work subject to copyright protection, without the written authorization of the copyright holder, constitutes an infringement. The infringing party cannot claim that he was acting in good faith. The fact that the copyright was not registered is also not a defense.
Where a person infringes copyright, the person is liable to pay such damages to the owner of the copyright as the owner has suffered due to the infringement and, in addition to those damages, such part of the profits that the infringer has made from the infringement and that were not taken into account in calculating the damages as the court considers just.
